EPN VideoBradford County Horse Cruelty InvestigationThis horse, along with his dam and her foal, were seized by the Bradford County Humane Society during the course of their investigation. The owner of this horse had Bob Oswald a farrier for 9 years trim this horse and testify in court in her defense. Mr. Oswald testified that he did not believe it was necessary to take any x-rays of this horse's hooves before trimming them. He testified that he had opened an abcess on this horse. He did not recommend the horse receive any medicine. Regarding cleanliness, on a scale of 1 to 10 he rated the barn a 3.5 to a 4. He described a barn that is a "1", as a barn with sawdust. A "3" is a barn that is picked daily. On cross examination he stated that he never brings a vet on any cases. When questioned regarding this horse's prognosis he stated he did not think he would run the Kentucky Derby, but he never rules anything out. He estimated that it would take 4 to 6 months to get the horse's feet in condition. The owner of the horses, Gail Lutz, stated on cross that the horses had not had farrier care for 2 years. The vet who took x-rays of this horse on September 20, 2001 failed to label the x-rays. Due to an accident this vet was also unable to testify in court. The x-rays were not allowed to be entered into evidence. An equine vet did testify at the hearing regarding laminitis and did discuss an x-ray that was apparent to spectators in the courtroom was an x-ray of this horse's foot. There was remodeling of the bone Due to the handling of this investigation by the Bradford County Humane Society, critical evidence was not allowed in and certain witnesses were not able to testify. The result? A not guilty verdict. Other video clips document the filthy conditions in the barn, the apparent dehydrated condition of the lactating mare and her exhibiting classic signs of laminitis. |
